This article is an inquiry into the discourse phenomenon of grounding, viz. the foreground-background structure. It explains the place of the phenomenon in the structure of discourse and provides evidence of grounding from short news items. Focusing on the surface structure level of discourse organization, the article examines variant marking of the FG-BG articulation at sentence-initial position. Using English and Arabic news data, the article explicates the grounding-signalling function of entities that appear in that position and shows that Arabic news (...) texts rely on certain prefatory expressions to signal the grounding values of underlying propositions. The study underscores the influence of the cognitive level of information on grounding and its marking in the hierarchical structure of discourse. (shrink)

Mullah Khalil al-Siirdī, who lived between the years 1750-1843, is a distinguished scholar that contributed to the intellectual life of his age with his life, works, and ideas. He attracted the attention of the madrasah members and intellectual milieu of his era through his scholarly writings. He affected the formation of the educational and intellectual life of masters and students. In this article, we have examined Mullah Khalil’s approach toward the issue of “ru’yat Allāh” by consulting, particularly his (...) books and other sources written on this matter, such as books, theses, encyclopedia entries, articles, etc.. At the beginning of the essay, we have presented brief information about Mullah Khalil’s life, education, and writings. Afterward, we have attempted to establish the lexical and terminological meanings of the term “ru’yat Allāh” and sects’ views regarding thereof. According to Mullah Khalil, even though it is theoretically possible to see God in this world with the naked eye while awake, it has not taken place [actually]. Prophet Moses wanted to see God while he was awake, but he could not do so. Mullah Khalil, based on Prophet Moses’ wish, believes the possibility of the vision of God and claims that it would not be appropriate for a prophet to ask for something impossible. Taking this possibility into consideration, Mullah Khalīl states that human beings can also see God in their dreams. (shrink)

Edhem (ö.161/778) ve Şakîk-i Belhî (ö.194/810) kanalıyla gelen öğretinin Horasan ve Maveraünnehir genelinde aktarım ve intişarının sağlamasında onun etkin bir rol oynadığı bilinir. Aynı zamanda yetiştirdiği talebeleriyle Melâmetîliğin teşekkülüne katkı sağladığı kabul edilir. Bu makale Hâtim el-Esam’ın entelektüel açıdan kimliği ve ilişkiler ağının tespitine odaklanmaktadır. Herhangi bir akademik çalışmaya konu edilmediği görülen söz (...) konusu odağı, farklı ilmî sahalardan istifade ettiği literatürle erken dönemdeki mesele ve tartışmalardan faydalanarak sunmaya çalışır. Bu itibarla Hâtim el-Esam’ın muhaddis, fakih ve sufi kimliğiyle Horasan ilim havzasının önemli şehirlerinden biri olan Belh’te ilmî faaliyetlerin ve özellikle hadis ilminin sürekliliğine katkı yaptığı ortaya konmuştur. Çok yönlü ilişkiler ağına sahip olduğu tespit edilen Hâtim el-Esam’ın Belh ve Bağdat ulemâsı ile irtibatının dostluk ve irşad eksenli ve aynı zamanda fıkh-ı bâtın vurgulu olduğu görülürken Rey, Kazvin ve Medine-i Münevvere ulemasıyla olan münasebetlerininse eleştiri odaklı olduğu belirlenmiştir. Nebevî mirasa bütünüyle sahip çıkılmamasına ilişkin söz konusu eleştirel münasebet biçimi, erken dönemde sufilerin, biçim-öz bütünlüğünden uzaklaşmaları nedeniyle diğer ilim müntesiplerine yönelttikleri tenkitlerin bir yansıması olarak değerlendirilmiştir. Grammar studies on Arabic started with Abu Aswad ad-Duali (d. 69/688) in Basra, the center of science and culture. Grammar studies have improved with scholars such as Khalil b. Ahmed (d. 175/791) and Sibeweyhi (d. 180/796) during the Abbasid period (750-1258). These studies, which continued in the style of commentary and annotation after the Abbasid period, reached its peak in the Ottoman period (1300-1922). One of the scholars who wrote a work in the style of commentary on the science (...) of nahw (syntax) is Ali b. Muhammed b. Mas‘ud al-Bistami al-Shahrudi (d. 875/1470). He became famous with the nickname Musannifak because he started to write books at a young age. 15th-century Ottoman scholar Alaaddin Musannifak Mas‘ud al-Bistami al-Shahrudi (d. 875/1470) grounded the nahw issues, he used the Qur’an, hadith and Arabic theology; he also applied to rational proofs such as qiyas and istishab. In this article, Musannifak’s method of applying only to narrated sources such as the Qur’an, hadith and Arabic words in order to reveal his methods of commentary is discussed. In this context, Musannifak’s method of reference to narrative sources in his commentary has been revealed with a qualitative approach by analysing his work on al-Misbah by Nasir b. Abdiseyyid b. ‘Ali al-Mutarrizi (d. 610/1213), Sharḥ al- Miṣbâḥ fi al-naḥw. (shrink)

İslâm geleneğinin en akılcı fırkası kabul edilen Mu‘tezile’nin özellikle Kur’an kıssaları çerçevesinde tefsirlerde yer bulan israilî rivayetler karşısındaki tutumu merak uyandırıcıdır. Bazı çalışmalarda kimi Mu‘tezilî müfessirlerin isrâiliyyât karşısındaki tutumuna değinilse de İsrâilî rivayetlerin tenkidi söz konusu olduğunda Mu‘tezile’nin bir ekol olarak tutumu herhangi bir araştırmaya konu edilmemiştir. İsrâiliyyât üzerine yapılan son çalışmalarda isrâiliyyât eleştirisinin İbnü’l-Arabî öncesinde Tûsî, Mâverdî hatta Mâtürîdî gibi isimlere kadar geri götürülebileceği söylenirken tamamen Sünnî ve Şiî müfessirler üzerinden bir okuma yapılmakta Mu‘tezilî müfessirlerin görüşlerine yer verilmemektedir. Oysa (...) bu çalışmalarda bahsedildiği üzere erken dönem isrâiliyyât eleştirilerinin genelde ismet meselesi ekseninde yapılması, Mu‘tezilî müfessirler özelinde bir incelemeyi zorunlu kılmaktadır. Nitekim isrâiliyyât eleştirisinde ön plana çıkartılan Mâtürîdî (ö. 333/944, Mâverdî (ö. 450/1058), Tûsî (ö. 460/1067), İbnü’l-Arabî (ö. 543/1148) ve İbn Kesîr (ö. 774/1373) gibi Sünnî ve Şiî müfessirlerden önce Ebû Bekir el-Esam (ö. 200/816), Ebû Alî el-Cübbâî (ö. 303/916) ve Ebû Müslim el-İsfahânî (ö. 322/934) gibi Mu‘tezilî isimler tarafından isrâiliyyât eleştirisinin yapıldığı görülmektedir. Her ne kadar onlar eserlerinde isrâiliyyât kavramını kullanmasalar da bu eleştirileri bazen rivayetlerin kaynağına bazen de içeriğine yöneltmektedir. Daha sonraki Mu‘tezilî âlimlerin de belli âyetler üzerinden bu eleştiriyi sistematik olarak devam ettirdikleri söylenebilir. Çalışmada öncelikle hicrî 2-6. asırda yaşamış el-Esam, Ebû Ali el-Cübbâî, Ebû Müslim el-İsfahânî, Kâdî Abdülcebbâr (ö. 415/1025), Cüşemî (ö. 494/1101) ve Zemahşerî (ö. 538/1144) gibi müfessirlerin, israiliyata bakışına odaklanılmaktadır. Söz konusu müfessirlerin farklı israilî rivayetler karşısındaki tutumu betimsel analiz yöntemiyle değerlendirilmektedir. Ayrıca aynı dönemdeki Sünnî müfessirlerin bu rivayetlere yaklaşımına da atıfta bulunulmaktadır. Mu‘tezilî müfessirlerin isrâiliyyâta yaklaşımı ele alınırken; onların bu rivayetleri reddetmeleri, isrâilî rivayetleri yorumsuz aktarmaları, aklî yorumu isrâilî rivayetlere tercih etmeleri ve isrâiliyyâtla âyetleri tefsir etmeleri gibi farklı yaklaşımlar hususunda ayrıma gidilmektedir. Mu‘tezilî müfessirler eserlerinde birçok İsrâilî rivayet aktarsa da özellikle tefsir geleneğinde sorunlu bazı rivayetlerin te’vilinde eleştirel yaklaşımın ilk örneklerinin onlardan gelen tefsirlerde olduğu söylenebilir. Bu bağlamda çalışmada klasik dönemde isrâiliyyat eleştirisinde Mu‘tezilî müfessirlerin öncü olduğu, özellikle ismet-i enbiyâ ve ismet-i melâike ile ilgili bir takım rivayetlerin eleştirisinin ilk önce Mu‘tezilî müfessirlerle başladığı sonucuna ulaşılmıştır. Yine Mâtürîdî, Mâverdî ve Tûsî gibi Sünnî ve Şiî müfessirlerin kimi yerlerde söz konusu rivayetleri eleştirirken Mu‘tezilî isimlere referansta bulunmasına da dikkat çekilmiştir. Son olarak Mu‘tezilî müfessirler, küllî bir isrâiliyyât eleştirisi yapmasalar da bazı yerlerde söz konusu rivayetleri “Yahudi uydurması ve Tevrat kaynaklı” olarak tanımlamaktadırlar. Bu da onların referans noktaları kendi kelâmî anlayışları olmakla birlikte rivayetleri kaynak açısından da eleştirdiklerini ortaya koymaktadır. Nitekim sistematik bir isrâiliyyât münekkidi olan İbn Kesîr de Peygamberlerin ismetiyle bağdaşmayan kimi rivayetlere tefsirinde yer vermeksizin reddettiği görülürken mucizevî olayları abartılı şekilde resmeden bazı isrâilî rivayetleri yorumsuz aktarmaktadır. Dolayısıyla Mu‘tezilî isimlerin İslâm inancıyla bağdaşmayan isrâilî rivayetlere erken dönemde eleştirel yaklaşması ve bunları nazara itibara almaması kayda değer bir tutumdur. (shrink)

Qaside-i Khamriyya (meaning Wine Eulogy) of sufi poet Ibn-i Fārıḍ, in which he explained divine love through the metaphor of wine, attracted great attention in Islamic world and was translated into Arabic, Persian and Turkish. Scholars such as Davud-i Qayseri (d. 751 AH/1350 AD), Kemal Pashazāde (d. 940 AH/1534 AD), Abdulghani an-Nablusi (d. 1143 AH/1731 AD), Ibn Acibe (d. 1224 AH/1809 AD) explained this eulogy in Arabic, while poets such as Ali b. Shihābiddin al-Hamadāni (d. 786 AH/1385 AD), Molla Cāmi (...) (d. 898 AH/1492 AD), Idris-i Bitlisi (d. 926 AH/1520 AD) wrote commentaries in Persian. On the other hand, authors such as Abdussalam b. Numan b. Khalil (d. 1000 AH/1592 AD [?]), Ismail Anqaravi (d. 1041 AH/1631 AD), Abdulmacid-i Sivasi (d. 1049 AH/1639 AD), Qara Musṭafa Khulūsi (d. 1344 AH/1926 AD), Meḥmed Naẓım (d. 1345 AH/1926 AD) and Ṭahir al-Mavlavi (d. 1371 AH/1951 AD) translated the eulogy into Turkish. One of the authors who translators of this eulogy was Mehmed Said Efendi, sheikh of Uskudar Salimiya Takka, who lived in the 19th century. His work named Ṭarab-angiz (meaning Pleasure-provoking) is a condensed commentary with ornate prose of Qaside-i Khamriyya. In previous studies, Ṭarab-angiz was partly examined, and there was no mention about the identity and personality of the author. In the present research, the life and personality of Meḥmed Said Efendi is explained and the text of his work is examined.Summary: In Turkish literature which developed under the influence of Islam, translations and commentaries have important a place along with original texts. Coming within the sphere of Islam in early 10th century, Turks embarked on translating the texts immediately in order to learn their new religion and to perform its practices and continued to do so since then. Because they lived in the same culture and civilization climate, Turks learned Islam from Persians and were influenced by Persian language. However, adherents of this new religion also made direct translations from Arabic texts. The translations initially were made from religious works, but in time social, cultural and literary works, such as Persian classics and major eulogies of Arabic Literature, were also translated into Turkish by Turkish scholars. Qaside-i Burde by Ka‘b b. Zuheyr’in (d. 24 AH/645 AD), Qaside-i Nūniyye by Ebu’l-Fetḥ Busti’nin (d. 400 AH/1010 AD), Qaside-i Ṭanṭarāniyye by Ṭanṭarāni’nin (d. 485 AH/1092 AD), Qaside-i Münferice by Ibnu’n-Naḥvi’nin (d. 513 AH/1119 AD), Qaside-i Emāli by Ali b. Othman al-Ushi’nin (d. 575 AH/1179 AD) and famous eulogy named Qaside-i Bur’e by Muḥammed b. Said al-Buṣiri’nin (d. 695 AH/1296 AD) were among such works.Qaside-i Khamriyya by sufi poet Ibn-i Fārıḍ (d. 632 AH/1235 AD), also called sultan of minstrels, in which he explained divine love through wine attracted great attention in Islamic world and was translated into many languages and many commentaries were written on it. One of the commentary writers about this eulogy is Meḥmed Said Efendi, a 19th century sufi. His work entitled Ṭarab-angiz is a condensed commentary with ornate prose of Qaside-i Khamriyya.Studies conducted so far has partly dealt with the Ṭarab-angiz and identity and personality of Meḥmed Said Efendi have never been mentioned. Ṣarac mentioned, “It is a printed work but its writer, printing date, and the place was not found on the printed work”, while Yıldırım used the expression of “a work whose writer and production date is not known.” In his Ph. D. thesis entitled Translation and Commentary Tradition in Classical Turkish Literature in Anatolia, Ṣadık Yazar noted that the work belongs to Meḥmed Said, which was later cited by Aqdag. The final statement on this issue was made by İnce in his work entitled Arabic, Persian and Turkish commentaries of Qaside-i Khamriyya by Ibnu’l Fārıḍ. He examined a total of 18 commentaries and stated that no information is available about the life of Meḥmed Said although he mentioned Ṭarab-angiz.The birth date and place of Meḥmed Said Efendi are unknown. He is grandchild of Ali Behjet Efendi (d. 1238 AH/1823 AD), one of sheiks in Salimiya Dervish Lodge in Uskudar and son of Meḥmed Hidāyetullah Efendi (d. 1288 AH/1871 AD). Following the death of his father, Meḥmed Said Efendi himself served as the head dervish of this dervish lodge for 25 years and became a famous figure. He died in 1313 AH/1896 AD and was buried in the cemetery of the Salimiya Dervish Lodge.Meḥmed Said Efendi was the sixth sheikh of Salimiya Dervish Lodge. In many sources, he was mentioned as a venerable, righteous, devoutly religious, virtuous, polite and scholarly man. Meḥmed Said Efendi is thought to be a member of Mavlavi lodge of Naqshbandi Ṭariqa. He had successors such as Naqshi sheikh Uskudari Balabani Ḥasan Ḥusnu Efendi (d. 1347 AH/1928 AD) and Ismail Efendi (d. after 1307 AH/1890 AD). The poet had a commentary named Ṭarab-angiz in prose form and had a quatrain within the praising eulogy of Sheikh Ḥāmil Efendi (d. 1322 AH/1904 AD), head sheikh of Beylerbeyi Bedevi Dervish Lodge.It is clear from the expression, “A work by Meḥmed Said, the Imam of Central Dervish Lodge of Sultan Salim III,” at the beginning of Edition no: 450 in Suleymaniye Library, Pertev Pasha Collection and from the record of “Work: Ṭarab-angiz, Author: Ibnu’l-Fārıḍ, Translator and postscript writer: Meḥmed Said” in Edition no: 7350 of Marmara University Faculty of Theology Library that this work belongs to Sheikh Meḥmed Said Efendi. However, exact production date of this printed work is not known. The work consisted of 28 pages and in some editions a two-page correct-false chart was added.As usual, the work starts with an introduction section with expressions of “By the name of God, the Most Gracious, the Most Merciful,” “Praise be to God,” and “Peace be upon Prophet Moḥammad.” This section also includes a praise for followers of Prophet Moḥammad, “Who made sphere of prophecy an eternal rose garden through the holy light of their enjoyed manners in addition to making the Shari’a candle shined and and converting them to great flowers of service with their strong inspiration torchs.” The commentator then embarked on praising Qaside-i Khamriyya, mentioning that the men of ability became helpless in explaination of beauty, charm and freshness of unique expression richness and refined allegory blossoms of the eulogy and that reaching the shore of rhetoric could be possible through diving into the guided wisdom of sea. In fact, according to commentator, the men of literature should be aware of the difficulty of translating this unique eulogy into Turkish language. However, everyone should dive into the sea of insight as a knowledge diver, collect its share in pearls of utterance and in emeralds of wits, arrange and put them in the string of prose”. Therefore, he wrote the commentary about the eulogy as a service to humanity and as a contribution to his own stock of comfort in the present and afterlife as much as he could, no matter how little it could be, and named it Ṭarab-angiz. Like most commentators of Qaside-i Khamriyya, Meḥmed Said Efendi commented on only about 33 couplets of the eulogy which contained a total of 41 couplets, and did not cover couplets from 23 to 30 in his work. The commentator used couplet-by- couplet translation method and started with praising for Ibn-i Fārıḍ and his couplets. Then, he gives the Arabic originals of the couplets and starts commentary with the expressions such as “couplets of great intuition, imagery couplets, product of couplet, enlightenment of couplet and concept of couplet.” In preface section of the work, the commentator, who usually quoted hadith texts in Arabic and poems, does not use them in his commentary. He only uses some lines of Arabic prayers and a quatrain of Molla Cāmi (d. 898 AH/1492 AD). This is a quatrain rubāi in Persian language meaning that “If you want no sorrow and no grief of the destiny, drink wine in a pub, because swirling of the goblet and worries of the world do not share the same place just as the tune and the sorrow do not coincide.” The lack of touching on the meaning of words, etymological structure and grammar rules in couplets makes it different from others, except the translation of Aḥmed Ṣāfi Bey. In questo contributo di introduzione al volume “Biodiversity” (Rivista di Estetica n. 59, 2015), dopo aver sottolineato il legame tra la realizzazione degli inventari biologici (le tassonomie) e lo studio della biodiversità, e la difficoltà di definire la biodiversità, prendo in esame tre diversi modi di intendere il valore della biodiversità. Oltre al valore etico ed estetico, oggetto rispettivamente di discipline relativamente recenti come l’etica ambientale e l’estetica ambientale, la biodiversità ha un valore economico, presente soprattutto nel cosiddetto approccio dei (...) servizi ecosistemici, dove la biodiversità è principalmente intesa nei termini dei servizi che gli ecosistemi possono offrire agli esseri umani presenti e futuri. In primo luogo evidenzia l'insegnamento averroista in relazione al tema dell'intelletto e dell'individuo, in secondo luogo esamina alcune proposizioni relative all'immortalità dell'anima individuale, ma sottolinea la difficoltà di conciliare tali affermazioni di Averroè con la dottrina dell'intelletto. L'ultima parte dello studio propone un esame critico del recente studio di O.N. Mohammed, Averroes, Aristotle, and the Qur'an on Immortality «International Philosophical Quarterly» 33 37-55.

La sua interpretazione del marxismo ha presentato una forte accentuazione umanistica. Tra i suoi scolari filosofi e storici della filosofia come Giulio Preti, Enzo Paci, Remo Cantoni, Paolo Rossi. Il saggio prende in esame la prima fase della riflessione filosofica di Banfi, nella quale ha una importanza decisiva la conoscenza diretta del (...) dibattito tedesco tra le due guerre mondiali, in primo luogo della fenomenologia di Husserl e della ontologia di N. Hartmann. I Principi di una teoria della ragione - libro apparso alla fine degli anni '20 - e poi una serie di incisivi saggi degli anni '30 documentano una conoscenza approfondita e critica di un dibattito di cui mostrerà di nutrirsi in misura decisiva l'interpretazione di Banfi non solo di Hegel, ma anche di Marx. Among the leading philosophers in Italy during the 20th century, Antonio Banfi played an important role not only in the cultural debate during the 1930s and the 1940s, but also in the political scene of post-war Italy, advocating - as a representative of the Italian Communist Party in Italian Senate - a liberal, humanist view of Marxism. Among his students were influential philosophers and historians of philosophy such as Giulio Preti, Enzo Paci, Remo Cantoni and Paolo Rossi. This paper investigates the first phase of Banfi's philosophical development, an analysis of which must include a scrutiny of Banfi's deep indebtedness to German debate between the two World Wars, primarily Husserl's phenomenology and Hartmann's critical ontology. Banfi's phenomenological apprenticeship at the school of Husserl, and the sensitive and critical attitude of his presentation of the German debate in his Principi di una teoria della ragione, are of substantial importance in nourishing his later interpretation of Hegel and Marx. This paper examines the ways Merleau-Ponty and Nancy think about light, a central theme in Western philosophy closely tied with form and intelligibility. The first section of this paper points out that each thinker replaces the “highest moment of light,” where it is relieved of its weight and materiality, with darkness, where light instead emerges from some apophantic depth indissociable from the material. The second section of this paper gives a critique of darkness in Nancy from Merleau-Ponty’s perspective. According to (...) the latter’s view, Nancy’s claim that darkness is distinct from the structures of intentionality and instead has to do with a presentation of the inappropriable fact of things would be untenable. The difference between the thinkers relates to how each thinks about negation after their very similar critiques of light and form. Still, I argue, the same critique of presentation in Nancy ought to also be applied to Merleau-Ponty, or at least to the usual way he is thought to favour the sensible instead of intelligibility. In the third section of this paper I consider one of Merleau-Ponty’s phrases, “there is no painting before painting,” a statement I take to be about how explicit formal structures, and thus also light and line, comes from a sensible register that does not lack variation and is not totally “deformed,” to use Nancy’s word that describes the homogeneity of a sensible field. Cet essai examine les différentes façons qu’ont Merleau-Ponty et Nancy de penser la lumière, un thème central de la philosophie occidentale, et qui est étroitement lié avec les idées de forme et d’intelligibilité. Pour Merleau-Ponty, l’affirmation de Nancy selon laquelle l’obscurité se distingue des structures de l’intentionalité et a plutôt affaire à la présentation du fait inappropriable de la chose serait tout à fait intenable. La différence entre les deux penseurs concerne la façon dont chacun pense la négation à partir d’une critique similaire de la lumière et de la forme. J’avance pourtant que la même critique de la présentation chez Nancy devrait aussi être appliquée à Merleau-Ponty, ou du moins à la façon dont il est habituellement vu comme préférant le sensible contre l’intelligible. Dans la troisième section, j’évalue la phrase de Merleau-Ponty, « la peinture n’existe pas avant la peinture », phrase qui selon moi concerne la façon dont les structures formelles explicites, et donc la forme et la ligne, proviennent d’un registre sensible qui n’est pas sans variations et donc pas totalement « déformé », pour utiliser le mot que Nancy emploie pour décrire l’homogénéité du champ sensible.Questo articolo prende in esame i modi in cui Merleau-Ponty e Nancy riflettono sulla luce, un tema centrale nella filosofia occidentale e strettamente connesso a quelli della forma e dell’intelligibilità. La prima sezione dell’articolo mostra come entrambi i pensatori sostituiscano “il più alto momento della luce”, che la libera dal suo peso e dalla sua materialità, con l’oscurità, in cui invece la luce emerge da una profondità apofantica indissociabile dalla sfera materiale. La seconda sezione offre una critica del concetto di oscurità in Nancy dal punto di vista di Merleau-Ponty. Secondo una prospettiva merleau-pontiana, la tesi di Nancy che l’oscurità sia distinta dalle strutture dell’intenzionalità e sia invece connessa a una presentazione dell’aspetto inappropriabile delle cose sarebbe insostenibile. La differenza tra i due pensatori riguarda il modo in cui ciascuno di essi elabora l’idea di negazione, a partire da due analisi della luce e della forma molto simili. Tuttavia, come cerco di mostrare, la stessa obiezione all’idea di presentazione in Nancy dovrebbe essere applicata anche a Merleau-Ponty, o quantomeno al modo in cui di norma si ritiene egli prediliga il sensibile piuttosto che l’intelligibile. Nella terza sezione, prendo in esame una frase di Merleau-Ponty, “non c’è pittura prima della pittura”, che a mio avviso si riferisce a come le strutture formali esplicite, e dunque anche la luce e la linea, provengano da un registro sensibile che non è privo di variazioni e che non è totalmente “deformato”, per impiegare un termine di Nancy che descrive l’omogeneità di un campo sensibile. This paper examines the shareholder primacy norm as a widely acknowledged impediment to corporate social responsibility and explores the role of business schools in promoting the SPN but also potentially as an avenue for change by addressing misconceptions about shareholder primacy and the purpose of business. We start by explaining the SPN and then review its status under US and UK laws and show that it is not a likely legal requirement, at least under the guise of shareholder value maximization. (...) This is in contrast to the common assertion that managers are legally constrained from addressing CSR issues if doing so is inconsistent with the economic interests of shareholders. Nonetheless, while the SPN might be muted as a legal norm, we show that it is certainly evident as a social norm among managers and in business schools—reflective, in part, of the sole voting rights of shareholders on corporate boards and of the dominance of shareholder theory—and justifiably so in the view of many managers and business academics. We argue that this view is misguided, not least when associated with claims of a purported legally enforceable requirement to maximize shareholder value. We propose two ways by which the influence of the SPN among managers might be attenuated: extending fiduciary duties of executives to non-shareholder stakeholders and changes in business school teaching such that it covers a plurality of conceptions of the purpose of the corporation. The essay replies to comments by Finnis, Gardner and Endicott, on my book, Law as a Moral Idea. It is questioned whether Finnis is right to suggest that governance by law is a requirement of justice. It is suggested that Hart's positivism may have rested upon an unduly private conception of morality. Gardner's suggestion that Law as a Moral Idea falsely manufactures disagreement with Hart is rejected, principally by pointing out that Gardner focuses upon only one issue, where the book (...) already acknowledges that Hart might conceivably agree, and ignores other issues where the disagreement with Hart seems indisputable. In response to Endicott, it is acknowledged that 'politics' could be understood as a moral idea comparable to the idea of 'law', but denied that this robs either thesis of interest. The nature of doctrinal reasoning and law's justificatory force is then discussed. (shrink)

There were five kinds of cyber deterrence presented at the workshop on Landscaping strategic cyber deterrence, hosted at the Oxford Internet Institute. They were the well-studied areas of deterrence by ‘punishment’ and ‘denial’, and the novel concepts of deterrence by ‘association’, ‘norms and taboos’, and finally, ‘entanglement’. In the following workshop commentary, I present these five kinds of deterrence and explain them in light of recent developments in the academy and industry. I argue for analytical congruence between all three novel (...) concepts, since they aim to alter the behaviour of actors by adding a social cost in response to breaking norms and conventions. Throughout, I argue that we are beginning to understand how cyber deterrence works, both in theory and practice, and when all concepts are taken together, they become more than the sum of their parts. Finally, I point out an omission of the workshop, where computational modelling and simulation could be added to the landscape of strategic cyber deterrence. (shrink)

The paper explores the manners in which suffering, both natural and moral suffering, is understood and defeated in the lives of different ‘knights of faith,’ who emerge in ‘conversation’ with the book of Job. I begin with Maimonides’ Job who emerges as a ‘knight of wisdom’; it is through wisdom that his suffering is defeated, dissolving into mere pain. I proceed with Kierkegaard’s Job, who emerges as a ‘knight of loving trust,’ who defeats suffering by seeing it as a divine (...) gift, and by obediently and lovingly accepting it as such. Through his loving trust, suffering transforms into blessedness and joy, without diminishing or disappearing, a transformation referred to as a ‘miracle’ by Kierkegaard. I end with my own Hasidic-inspired Job, whom I portray as a ‘knight of protest,’ who defeats what he takes to be divine abuse by protesting against it, forgiving God while refusing to be reconciled with Him. I argue that it is by paying attention to these diverse Jobs that the complex nature of faith can be elucidated. Moreover, I argue that all three Jobs, despite their differences, may be embraced, both from a philosophically descriptive perspective as well as from a religiously committed one. (shrink)

The automatic verification of large parts of mathematics has been an aim of many mathematicians from Leibniz to Hilbert. While Gödel's first incompleteness theorem showed that no computer program could automatically prove certain true theorems in mathematics, the advent of electronic computers and sophisticated software means in practice there are many quite effective systems for automated reasoning that can be used for checking mathematical proofs. This book describes the use of a computer program to check the proofs of several celebrated (...) theorems in metamathematics including those of Gödel and Church-Rosser. The computer verification using the Boyer-Moore theorem prover yields precise and rigorous proofs of these difficult theorems. It also demonstrates the range and power of automated proof checking technology. The mechanization of metamathematics itself has important implications for automated reasoning, because metatheorems can be applied as labor-saving devices to simplify proof construction. (shrink)

¿Cómo es que un sistema cognitivo del que se dice no habría surgido para conocer, sino para sobrevivir, ha venido a conocer tantas cosas evolutivamente inútiles y -por qué descartarlo hoy- hasta nocivas para la supervivencia de la especie? El saber filosófico despierta, dirán Aristóteles o Hegel, una vez satisfecho lo necesario para la existencia. Puede incluso que la superfluidad sea esencial a la cultura, pues lo superfluo es para el hombre, según la expresión de Voltaire, «cette chose si nécessaire!». (...) Ese desequilibrio entre utilidad natural y uso cultural de la razón avala bien el rechazo a ver en ésta un elemento más de la naturaleza. Aceptarlo obligaría a normalizar su estudio y -consecuencia o premisa inevitable- a naturalizar su concepto. Ambas cosas conllevarían además una incursión, insolente no sólo para el filósofo, de las ciencias particulares en los dominios tradicionales de la filosofía, dominios con tanta acucia conseguidos a lo largo de su historia. No obstante, quienes estén convencidos de que la naturalización de la razón equivale al suicidio de la filosofía, y la rehúsen por ello, deberían sopesar antes las razones por las que habría de ser preferible salvar la filosofía a naturalizar la razón. Tal vez descubran al paso qué ancestral, qué prefilosófica es su idea de la filosofía. (shrink)
